NO PURCHASE NECESSARY TO ENTER OR WIN.
Please read these Official Rules before entering the Connect This! The Embedded Internet Challenge offered by Intel Corporation (the "Promotion") to be conducted by Intel Corporation ("Sponsor"). By participating in the Promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements set out herein below.
1. Eligibility: An application for entry into the Promotion must be submitted through a legal resident of either the fifty (50) United States (including District of Columbia), Canada, China (including residents of Taiwan), Germany, India, and the United Kingdom at least eighteen (18) years of age or older (twenty (20) years of age or older if residing in Taiwan) at the time of entry. Employees of Intel Corporation, ePrize, LLC and all advertising and promotional agencies affiliated with the Promotion and their respective parent companies, subsidiaries, advertising and promotion agencies, and their immediate family members and those living in the same household of each, are ineligible. All applicable federal, state, provincial and local laws and regulations apply. The promotion consists of a contest (the "Contest") and a sweepstakes (the "Sweepstakes"). Void where prohibited. Participation in the Promotion is voluntary.
2. Sponsor: Intel Corporation, 2200 Mission College Blvd., Santa Clara, CA 95052, U.S.A. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069, U.S.A.
3. Agreement to Official Rules: By participating in the Promotion, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters. Prize receipt is contingent on fulfilling all requirements set forth herein.
4. Timing: The Promotion begins on September 15, 2009 at 12:00 a.m. Pacific Standard Time ("PST"), ends on December 15, 2009 at 11:59 p.m. PST (the "Promotion Period") and consists of four (4) monthly drawing periods (each a "Drawing Period"). Each Drawing Period will be exactly a calendar month in length, except for the first Drawing Period, which will start on September 15, 2009 and end on September 30, 2009 and the last Drawing Period, which will start on December 1, 2009 and will end on December 15, 2009. Sponsor's computer is the official time-keeping device for this Promotion.
5. How to Enter: During the Promotion Period, visit http://www.intel.com/embedded/15billion, click on the "Connect This: The Embedded Internet Challenge" link, and follow the instructions to "create an account" (the "Account"). Registering for an Account is free, but requires you to provide your first and last name, a valid email address and a valid home mailing address. P.O. Boxes are not permitted. Once logged into your Account, follow the instructions to submit a one thousand two hundred (1,200) character or fewer proposed idea that describes an intelligent, connected device from at least one (1) of the categories provided in the "Category" drop down list that addresses at least one (1) of the attributes listed in the "Featured technology" drop down list (the "Idea"). You will receive one (1) entry into the Contest and one (1) entry into the Drawing Period corresponding with the date your entry was received. Only entries submitted via the online URL will be accepted. By uploading your Idea, you agree that your Idea conforms to the Idea Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and Restrictions") and that Sponsor, in its sole discretion, may remove your Idea and disqualify you from the Promotion if it believes, in its sole discretion, that your Idea fails to conform to the Guidelines and Restrictions.
- Idea Guidelines:
- The Idea must be in text format;
- The Idea must be one thousand two hundred (1,200) characters or fewer in length;
- The Idea must be in English; and
- The Idea cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
- Content Restrictions:
- The Idea must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or patent infringement;
- The Idea must not disparage Sponsor, Administrator or any other person or party affiliated with the promotion and administration of this Promotion;
- The Idea must not feature brand names or trademarks other than the Intel mark, which entrant has a limited license to use for the sole purpose of creating and uploading a Idea in this Promotion;
- The Idea must not contain text not created by entrant;
- The Idea must not contain text that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
- The Idea must not contain text that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
- The Idea must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Idea is created.
For All Ideas: Limit: You may submit one (1) Idea per day during the Promotion Period. Ideas received from any person or email address in excess of the stated limit will be void. Ideas generated by script, macro or other automated means are void. The person who creates the Account used to upload the Idea will be deemed to be the entrant. In the event there is a conflict between the Account Terms and Conditions and these Official Rules with regard to this Promotion, these Official Rules shall prevail. Uploading an Idea constitutes entrant's consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Ideas in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. Depending on the specific circumstances of the use of the Ideas, specific recognition of the entrant who submitted the Idea may or may not be given (a determination which is at the sole discretion of the Sponsor or any party designated to use the Idea by the Sponsor). If necessary, entrant will sign any necessary documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Idea in any marketing materials or promotional items. Released Parties (as defined in Section 11, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Ideas; all of which will be void.
In the event of a dispute as to any Idea, the authorized account holder, at time of entry, of the email address used to create the applicable Account will be deemed to be the entrant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The entrant may be required to show proof of being the authorized account holder.
The personal data an entrant submits upon registration will be stored on servers in Canada and the United States of America. Entry into the Promotion constitutes entrant's consent to the export of his/her personal data to the United States of America and its use there for the purposes of administering this Promotion and associated processing (e.g., but not limited to back-up, archiving). The servers are controlled by the Sponsor and/or the Administrator who have notified the U.S. Department of Commerce that they adhere to the rules of the Safe Harbor Framework available under http://www.export.gov/safeharbor/SH_Privacy.asp. Entrants' personal data will be stored on these servers and used for the purposes of administering this Promotion and associated processing of entries.
6. Winner Selection: Winners will be determined according to the process set forth below.
(a) For Grand, First and Second Prizes: At the conclusion of the Promotion Period, qualified judges (the "Judges"), whose decisions regarding this Promotion and the selection of potential Contest Prize winners are final and binding in all matters, will select from all eligible entries received during the Promotion Period, the potential Grand, First and Second Prize Contest winner based on the following criteria (the "Judging Criteria"):
- (i) Coolness of Idea (20 points);
- (ii) Ability of Idea to feature an innovative use of an Intel application (15 points);
- (iii) Positive societal impact of Idea (15 points); and
- (iv) Positive environmental impact of Idea (15 points); and
- (v) Number of votes received during the Promotion Period per the voting process set forth in Section 6(b), below (10 points);
In the event of a tie between two (2) or more Ideas for any prize, the Idea the Judges determine to feature the most innovative use of an Intel application will be the potential prize winner of the applicable prize. The potential Contest Prize winners will be notified on or around January 4, 2010.
(b) Public Voting and People's Choice Prize Selection: During the Promotion Period, each entrant's Idea will be posted in an online gallery for public voting at http://ConnectThis.intel.com. Account holders will be invited to vote for the Idea they believe has the most public appeal. The Idea who receives the most votes at the conclusion of the Promotion Period will be the potential People's Choice Prize winner. Limit: Each voter may vote one (1) time per unique Idea per day during the Promotion Period. Multiple votes received from any person or email address after the first vote received from that person or email address will be void. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Multiple voters are not permitted to share the same email address. Any attempt by any voter to submit more than the stated number of votes by using multiple/different email addresses, identities or any other method will void that voter's Idea(s) (if any) and votes and he/she will be disqualified from further participation in the Promotion. Use of script, macro or any other automated system to vote is prohibited and all such votes will be void. Released Parties (as defined in Section 11 below) are not responsible for lost, late, incomplete, garbled, delayed, invalid, unintelligible or misdirected votes, which will be void. In the event of a dispute as to any vote, the authorized account holder of the email address used to vote will be deemed to be the voter. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
(c) For Sweepstakes Prizes: Administrator, an independent judging organization whose decisions as to the selection of the potential Sweepstakes Prize winners are final and binding in all matters related to the Sweepstakes, will randomly select one (1) Sweepstakes Prize winner per Drawing Period from amongst the ten (10) unique entrants whose Ideas received the ten (10) highest number of votes during the respective Drawing Period. Each potential Sweepstakes Prize winner will be notified on the second Monday following the conclusion of each Drawing Period. The odds of winning a Sweepstakes Prize depends in part on the number of votes your Idea receives during a Drawing Period and, if it is one of the ten (10) Ideas that receive the highest number of votes during the respective Drawing Period, are 1:10.
7. Requirements of the Winner: Potential Contest Prize winners (or parent/legal guardian if a minor in his/her state or country of residence) to sign and return to Administrator an Affidavit of Eligibility, Liability & Publicity Release (if U.S., Chinese, German, Indian or Taiwanese resident) (the "Affidavit"), a Declaration of Compliance (if Canadian resident) ("Declaration") or a Confirmation of Eligibility and Liability/Publicity Release (if U.K. resident) (the "Confirmation"), where permitted, within ten (10) days of notification. Additionally, potential winners from Canada will be required to correctly answer and return, within ten (10) days from the date the Declaration is sent, a time-limited skill testing question without any assistance in order to be eligible to receive a prize. If a potential winner of any prize cannot be contacted, is no longer eligible, fails to properly execute or return the Affidavit, Declaration or Confirmation within the required time period (if applicable), fails to correctly answer or return the skill testing question (if applicable) or if notification or prize is returned as un-deliverable, he/she will be disqualified and will forfeit the applicable prize. If a potential Contest Prize winner is disqualified, then the entrant who the Judges deem to have the next best Idea will be the potential winner of the applicable prize. If a potential Sweepstakes Prize winner is disqualified, then Administrator will award the applicable Sweepstakes Prize to an alternate winner via a random drawing from amongst the remaining nine (9) entrants whose Ideas received the highest number of votes during the respective Drawing Period. There will be three (3) attempts to confirm a winner for each prize, after which the applicable prize will remain un-awarded. Prizes will be fulfilled approximately eight (8) to ten (10) weeks after the conclusion of the Promotion. Acceptance of any prize shall constitute and signify winner's agreement and consent that Sponsor and its designees may use the winner's, name, city, state, likeness, photo, Idea and/or prize information in connection with the Promotion for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Without limiting the generality of these Official Rules, winner shall irrevocably grant, transfer, convey and assign to Sponsor the entirety of the rights, or for entrants residing in a country in which the copyright cannot be transferred as such, the exclusive usage of such rights, including in and to the Idea and all renewals and extensions of copyright, and the right to secure copyright registrations thereto in perpetuity, where applicable, including, without limitation, the rights to use the Idea for any and all purposes in any and all media whether now known or hereafter developed, on a worldwide basis, in perpetuity. Winner accepts and acknowledges that Sponsor shall not be obligated to use the Idea and that Sponsor in its sole discretion shall have the right to refrain from using the Idea. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Winner will indemnify Sponsor, Released Parties (as defined in Section 11, below) and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms.
8. Prizes:
(a) Contest Prizes: ONE (1) GRAND PRIZE: $10,000 USD. ONE (1) FIRST PRIZE: $5,000 USD. ONE (1) SECOND PRIZE: $2,000 USD. ONE (1) PEOPLE'S CHOICE PRIZE: $1,000 USD.
(b) Sweepstakes Prizes: FOUR (4) SWEEPSTAKES PRIZES (one (1) Sweepstakes Prize per Drawing Period): $200 USD. Total ARV of all Sweepstakes Prizes: $800 USD.
For All Prizes: Limit: One (1) Contest Prize and one (1) Sweepstakes Prize per person. Prizes are non-transferable and no substitution for any prize will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value. Each winner is responsible for all taxes and/or fees associated with prize receipt and/or use.
9. Publicity: Except where prohibited, participation in the Promotion constitutes each entrant's consent to Sponsor's and its agents' use of winner's entry and/or Idea, name, likeness, photograph, voice, opinions and/or hometown, state, and country for promotional purposes in any media, worldwide, without further payment or consideration. Sponsor shall have the right to edit, adapt, and publish any or all of the Entries and/or Ideas for publicity purposes.
10. General Rules: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the operation of the Promotion or to be acting in violation of these Official Rules, or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of liability: Participants, by participating in this Promotion, hereby waive and release, and agree to hold harmless Sponsor, ePrize, LLC, all promotions and advertising agencies affiliated with this Promotion, and their respective parents, subsidiaries, affiliates, distributors, advertising and promotions agencies and all of their respective officers, directors, employees, representatives and agents (the "Released Parties"), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Promotion, or their participation in the Promotion, or their participation in any Promotion or prize related activity, or any travel related to the Promotion or any travel for any prize related activity. Winner also further acknowledges that the Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or these Promotion including but not limited to quality, condition or fitness for a particular purpose. Sponsor and Administrator are not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Promotion. If for any reason an entrant's Sweepstakes entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the Sweepstakes prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. For Residents of Germany: This Release does not apply to claims against Sponsor, its representatives and its vicarious agents for damages because of personal injury or death, and to claims for damages in case of intent or gross negligence by Sponsor, its representatives or vicarious agents. For United Kingdom residents: this release does not apply to claims for personal injury or death caused by the negligence of Sponsor or Administrator.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. DEPENDING UPON YOUR JURISDICTION OF RESIDENCE, ANY OF THE ABOVE (INCLUDING THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES) MAY NOT APPLY TO YOU. Subject to the specifics of local law, this paragraph will be given as much effect as possible. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A., without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A. For Residents of Germany Only: This limitation to the amount of damages does not apply if not permitted by law.
13. Personal Information: Information collected from entrants is subject to ePrize's Privacy Policy (http://www.eprize.com/privacy/privacypolicy.html) and Sponsor's Privacy Policy (http://www.intel.com/sites/corporate/privacy.htm?iid=homepage+ftr_privacy). Personal information will be used to: (a) contact potential winners; and (b) to send additional information to an entrant if an entrant selects to receive additional information from the Sponsor on the entry form. Entrants have the right to access, withdraw, and correct their personal data. Entrants may request such action by sending a message to "Intel® Connect This Opt-Out Request," c/o ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069, U.S.A.
14. Winners' List Requests: Winners' List requests will only be accepted after the promotion end date (listed above) and no later than May 4, 2010. For the Winner List, send an email with subject line: "Intel® Connect This, Winner List Request," to WinListRequests@eprizefulfillment.com.
15. General: Nothing in these Official Rules shall be deemed to exclude or restrict any of the Winner's or entrant's statutory rights as a consumer.
16. For Residents of Germany: Pursuant to German data protection laws, you have a right to information about the personal data stored about you, including its origin, recipient or categories of recipients of the data and the purpose of the storage. In addition, you have the right of correction and, in certain circumstances, to disabling and deletion of your data and, in certain circumstances, the right to object to the collection, processing and use of your personal data.
